Fine & Licitra has helped both domestic and international clients to resolve problems in federal and state courts arising out a broad array of commercial relationships. In addition to such frequently-occurring circumstances as non-payment for goods or services and default on loans, other examples of our commercial cases include the following:

Banking – We have represented domestic and foreign clients who were victims of bank fraud involving forged checks and fraudulent wire transfers. In these cases, we overcame the bank's legal defenses and showed that there was no evidence of our clients' involvement in any fraud. The banks eventually settled favorably to the clients.

Shareholder and Partnership disputes – We have represented numerous clients who owned half or less of a business and were shut out of the business by the other co-owner. Remedies in these types of cases typically include forcing a buyout at a fair price.

Ownership of money, securities, or other assets – Two of the largest cases we have handled in recent years were intra-familial disputes involving millions of dollars that South Americans held in Miami accounts. In both cases, the joint accountholders were multiple family members. In one case, some of the joint holders transferred millions of dollars and valuable bearer shares from joint control to their exclusive control. We succeeded in having the money frozen and bearer shares blocked until the court could rule on their ownership. The defendants appealed the injunction, and we prevailed on the appeal. This ruling facilitated a settlement in the parties' home country.

In the other case, one joint holder's refusal to authorize a withdrawal prevented his family member from having access to millions of dollars which were hers. After defeating the defendant's procedural defenses – including a forum non conveniens motion designed to have the case litigated in South America rather than Miami - our clients received their full share of the Florida-based assets and divided the foreign assets by agreement. In both cases, the rulings we obtained in Florida triggered settlements which were far more favorable to our clients than anything they could have obtained at the time they first came to us.

The foregoing are examples of the variety of business-related disputes with which we have been able to help our clients.
